Effective legal research draws on three main sources, and a good researcher knows how to move between them:

  • Statutes (the written law): the Acts and codes passed by legislatures. The starting point is always identifying which statute applies to the facts.
  • Precedents (case law): past judgments of higher courts, which lower courts must generally follow. Finding the right precedent, one with similar facts and a clear ruling, is often decisive.
  • Judicial interpretation: understanding how courts have interpreted a statute or principle over time, since the same words can be applied differently as the law develops.
